Liability Waiver

Please read the following terms carefully. By participating in any class provided by Hustle & Flow (the “Instructor”), you acknowledge and agree to the terms outlined below. This waiver applies to all current and future classes you attend unless otherwise notified in writing by Hustle & Flow

Acknowledgement of Risk

By signing up for or attending a class, you confirm that:

  • You are at least 16 years of age.

  • You understand that all Hustle & Flow classes involve physical exercise, which carries inherent risks of injury.

  • You agree to participate at your own risk and are responsible for assessing your physical capability to take part in any class.

  • You will immediately inform the Instructor of any pain, discomfort, or adverse symptoms experienced during class and cease participation if asked to do so by the Instructor.

Health Disclosure

You agree to disclose any relevant medical or physical conditions that could impact your ability to participate safely in class, including but not limited to:

  • Injuries, chronic pain, or recent surgery

  • Pregnancy or recent childbirth

  • Respiratory or cardiovascular conditions, including high blood pressure

You understand that based on the information you provide, the Instructor may, at their sole discretion:

  • Refuse your participation in a class, or

  • Require a medical clearance before allowing you to attend.

Your Responsibilities

  • You acknowledge that guidance and recommendations provided during class may not be specific to your personal fitness level or limitations.

  • It is your responsibility to listen to your body and modify or skip any movements as needed.

  • You are responsible for ensuring your personal safety and environment (for online or off-site sessions) is suitable for participation.

  • You understand that classes may be recorded for internal training or promotional use. If you do not wish to appear in any marketing content, you must notify Hustle & Flow in writing prior to the class.

Release of Liability

To the fullest extent permitted by law, you hereby release and hold harmless Hustle & Flow, its directors, employees, and representatives from any and all liability, costs, claims, or damages (including those arising from negligence) related to or arising from:

  • Personal injury or illness sustained during or after participation

  • Loss or damage to personal property

  • Any other loss or harm incurred while engaging in any Hustle & Flow class or activity

By attending a class, you confirm that you have read, understood, and agreed to the above waiver and release.

Class Cancellations Summary

Class cancellation and no-show policies vary by studio location.

Before booking, it is your responsibility to review and understand the cancellation policy that applies to the studio you are attending.

PAYMENTS

Memberships

The client will complete a direct debit authority online and select a preferred membership. Payments are deducted weekly from the nominated bank account.

Class Packs

The client will purchase online using a debit or credit card. Class packs activate from the date of the first booked class and must be used within the designated validity period.

Casual Classes

Casual class purchases are strictly non-refundable and remain valid for 1 year unless booked.

This includes situations where:

  • a client books into a waitlisted class using a casual pass and does not get into the class

  • a client changes their mind after purchase

  • a client is unable to attend their booked session

By purchasing a casual class, the client acknowledges and agrees that casual class purchases are strictly non-refundable and non-transferable.

Cancellations & Refunds

For memberships and class packs: classes cancelled at least 12 hours prior to start time will be credited back.

For casual classes: no refunds apply under any circumstances once purchased.

The client agrees to pay all fees on time. Failed payments must be resolved within 3 days.

Late payment fees may apply. Hustle & Flow is not responsible for any bank charges related to dishonoured payments.

MEMBERSHIP OPTIONS

All memberships are billed weekly. Allocated classes are valid for that billing week only and do not roll over. Clients are responsible for managing their bookings within their billing cycle via the MindBody or Hustle & Flow app.

Current Membership Options

  • Unlimited Membership: $69.95/week
    Unlimited access to classes.

  • Basic Membership: $27.00/week
    1 class per week.

  • Fixed-Term Memberships

    • 2 x Week – 6 Month Membership: $51/week
      Access to up to 2 classes per week during the client’s billing cycle.

    • 2 x Week – 12 Month Membership: $47/week
      Access to up to 2 classes per week during the client’s billing cycle.

Unused membership classes do not roll over into future weeks.

  • 30-Day Cancellation Notice (Unlimited & Basic Memberships only)

  • Membership Holds (see below)

Other Payment Options

  • Casual Class: $35.00
    Non-refundable.

  • Class Packs

    • 5 Pack: $162.50 (2-month expiry from first booked class)

    • 10 Pack: $300 (3-month expiry from first booked class)

    • 20 Pack: $530 (6-month expiry from first booked class)

  • Intro Offer (for new clients only)

    • 4 Classes for $60

    • Valid for 14 days from first class.

    • Non-refundable, non-transferable, and redeemable once per client only.

MEMBERSHIP HOLDS

Unlimited & Basic Memberships

  • Hustle & Flow offers the option to place your membership on hold under the following conditions:

  • Minimum hold duration: 2 weeks

  • Maximum hold allowance: 12 weeks total per calendar year

  • Hold requests must be submitted via the official membership hold form here Open-ended or indefinite holds are not permitted.

  • A minimum of 7 days’ notice is required before the requested hold start date to ensure processing.

  • Your membership will automatically resume on the specified end date, and regular billing will recommence.

  • Memberships cannot be cancelled while on hold.

  • If you wish to cancel your membership, the hold must be lifted first, and the 30-day cancellation period will begin from the date the cancellation request is submitted.

Hustle & Flow reserves the right to decline hold requests that exceed the 12-week annual allowance or that do not meet the outlined criteria.

A studio-wide freeze may apply over the Christmas/New Year break. This period does not count toward the total allowed hold time.

Fixed-Term Memberships

  • 6-Month Membership
    The client may freeze their membership for a maximum period of 4 weeks over the 6-month term.

  • 12-Month Membership
    The client may freeze their membership for a maximum period of 6 weeks per year.

At least 1 week’s notice is required for membership pause requests. Pause requests must be submitted via the official membership hold form here.

Hustle & Flow does not offer open-ended holds.

MEMBERSHIP CANCELLATIONS & DOWNGRADES

Unlimited & Basic Memberships

All ongoing Hustle & Flow memberships (including Unlimited and Basic) require a minimum of 30 days’ notice to cancel or downgrade.

  • Cancellation requests must be submitted via the official cancellation form.

  • The 30-day notice period begins from the date the cancellation request is received.

  • During this 30-day period, membership payments will continue, and the client may continue attending classes as normal.

  • Membership access will end after the final billing cycle within the 30-day notice window.

  • Hustle & Flow does not provide refunds for unused classes during the notice period. It is the client’s responsibility to use any remaining credits before the membership concludes.

Fixed-Term Memberships

  • 6-Month Membership
    Cancellation is only permitted due to injury, illness, or exceptional circumstances. Supporting medical documentation may be required.

  • 12-Month Membership
    Cancellation is only permitted due to injury, illness, or exceptional circumstances. Supporting medical documentation may be required.

Fixed-term memberships cannot otherwise be cancelled before the end of the contract term.

BOOKING CLASSES

Clients must book classes online and cancel online as needed via the Hustle & Flow app, Mindbody app or Website.

Waitlist

If a class is full, clients can join the waitlist.

  • If a cancellation occurs more than 12 hours prior, the first person on the waitlist will automatically be added and notified via email.

  • For cancellations within 12 hours, clients may be contacted manually via phone or email to confirm attendance.

Payment must be made before attending. By booking, you agree to these terms.

NO-SHOW & LATE CANCELLATION POLICY

To ensure fairness to all clients and to respect our instructors’ time, the following late cancellation and no-show policy applies:

  • A late cancellation is any class cancelled within 12 hours of the scheduled start time.

  • A no-show is failing to attend a class without cancelling.

Application by Membership Type

Unlimited Memberships

Currently, Hustle & Flow Ōakura does not charge a late cancellation or no-show fee for Unlimited Membership holders.

However, repeated late cancellations and no-shows create disruption for waitlisted clients and instructors. Hustle & Flow reserves the right to introduce a late cancellation/no-show fee in future if ongoing misuse of the booking system becomes an issue.

Basic Memberships, Fixed-Term Memberships & Class Packs

Late cancellations or no-shows will result in the loss of the class credit. No additional fee will be charged.

This policy allows waitlisted clients the opportunity to attend classes and helps us maintain a smooth and fair booking system. By booking a class, you agree to these terms.

GENERAL ETIQUETTE

  • Please arrive on time. Clients who are more than 5 minutes late may be refused entry.

  • New clients must arrive 5–10 minutes early to be inducted to the reformer.

  • Classes are non-transferable and must only be used by the person who purchased them.

  • Hustle & Flow reserves the right to cancel classes if minimum attendance isn’t met.

  • Trainers and classes are subject to change without notice.

  • Minimum age is 16 (exceptions considered case-by-case).

  • Please do not attend class if unwell or contagious.

  • Gift cards are non-refundable, non-transferable, and not redeemable for cash.

PRIVACY

Your personal information is used solely for health, wellbeing, and operational purposes and will only be accessible to Hustle & Flow staff.

INDEMNITY

Hustle & Flow accepts no liability for injury, damage, or loss of property. Personal belongings are stored at your own risk.

PHOTOGRAPHY & MARKETING

Instructors may record or photograph sessions for training and promotional use. If you do not consent, please notify the instructor in writing before class.

All signatories to this agreement give permission for Hustle & Flow or any licensed provider to use their image for marketing purposes.

LEGAL ENTITY

Hustle & Flow operates under Forty5 Movement Collective Ltd, a New Zealand registered company. By using our services, you agree to these Terms and Conditions.

Memberships

    Includes access to up to two classes per rolling 7-day period. Unused classes do not roll over into the following week. This membership includes all standard Queenstown membership perks and benefits. A minimum of 30 days’ notice is required for any membership cancellation requests, submitted via the appropriate form. Membership pauses require a minimum of 1 week’s notice prior to the requested pause date. Late cancel and no-show policies apply to all bookings.

All memberships include:

  • 30-Day Cancellation Notice

  • 50% off Community Events

  • 10% off at The Boatshed Bakery, Fino and The Italian Way

  • Bring-a-Friend Free – Once per month

  • Membership Holds (see below)

Casual Class: $40.00 and is non-refundable.

Class Packs:

PARKING ACCESS (Unlimited Memberships Only)

Free Marina Parking is exclusively available to clients on the Unlimited Membership plan.

  • Parking access is managed via a fob system.

  • If your membership is placed on hold, your parking fob will be temporarily deactivated for the duration of the hold.

  • Parking fobs are to be returned if your membership is cancelled or downgraded.

  • If a parking fob is lost, not returned, or damaged, a $20 replacement fee will be charged to your account to cover the cost of a new fob.

Clients on Basic or Casual memberships, or those using class packs, are not eligible for free parking at the marina.

BOOKING CLASSES

Clients must book classes online and cancel online as needed.

Waitlist:
If a class is full, clients can join the waitlist.

  • If a cancellation occurs more than 12 hours prior, the first person on the list will be automatically added and notified.

  • For last-minute cancellations (within 12 hours), you’ll be contacted manually.

No-Show & Late Cancellation Policy
